Terms and Conditions

Effective Date: 9th of February, 2025

1. Introduction

Welcome to WinWise, a lottery prediction service operated by Infernal Labs Pty Ltd (“we”, “our”, “us”). By using our website, mobile application, or services (collectively, “Services”), you agree to these Terms & Conditions. These terms govern your access to and use of WinWise and form a legally binding agreement under Australian Consumer Law (ACL).

If you do not agree with any part of these Terms, do not use our Services.

2. Definitions

• WinWise: The software and services provided for lottery number predictions.

• Infernal Labs Pty Ltd: The legal entity responsible for operating WinWise.

• User: Any individual who accesses, downloads, or subscribes to WinWise.

• Subscription: A paid service granting access to WinWise’s features.

• AI Prediction System: The proprietary system used to generate number predictions based on statistical models.

• Australian Consumer Law (ACL): The legislation under the Competition and Consumer Act 2010 (Cth) that protects consumer rights.

3. Disclaimer & Limitation of Liability

3.1 No Guarantee of Winning

WinWise provides probability-based lottery predictions using statistical models. These should be used for entertainment and informative purposes only. We do not guarantee any winnings, profits, or specific results.

3.2 Risk Acknowledgement

You acknowledge that lotteries are games of chance, and using WinWise does not guarantee a financial return. You assume full responsibility for any financial loss incurred.

3.3 Limitation of Liability

We are not liable for:

• Any financial loss or damages resulting from lottery participation.

• Any incorrect, misleading, or delayed predictions generated by our AI system.

• Any technical issues, service outages, or software errors affecting access.

• Any loss of data, unauthorised access, or security breaches despite reasonable protection measures.

Nothing in these terms limits your rights under Australian Consumer Law (ACL), including guarantees that cannot be excluded.

4. User Obligations

By using WinWise, you agree that:

• You are 18 years or older, or meet the legal age requirement for lottery participation in your state.

• You will not misuse WinWise for fraud, illegal gambling, or any unlawful activity.

• You understand that WinWise does not provide financial, legal, or investment advice.

• You agree not to distribute, resell, or reverse-engineer the software.

Any breach of these obligations may result in termination of access and legal action where applicable.

5. Subscription & Payments

By using WinWise, you agree that:

• You are 18 years or older, or meet the legal age requirement for lottery participation in your state.

• You will not misuse WinWise for fraud, illegal gambling, or any unlawful activity.

• You understand that WinWise does not provide financial, legal, or investment advice.

• You agree not to distribute, resell, or reverse-engineer the software.

5.1 Subscription Model

WinWise operates on a monthly subscription basis, granting access to predictive algorithms and analytics.

5.2 Billing & Auto-Renewals

• Subscriptions auto-renew unless cancelled at least 24 hours before the next billing cycle.

• Users are charged via App Store (iOS) or Google Play (Android) based on the selected plan.

• Failure to process payment may result in suspension or termination of service.

5.3 Cancellation & Refunds

• You may cancel your subscription at any time through your app store settings.

• Refunds are not provided for unused portions of a billing cycle unless required by Australian Consumer Law (ACL).

• If WinWise is unavailable for an extended period due to technical failures, we may offer credit or pro-rata refunds at our discretion.

6. Fair Use Policy

WinWise implements a Fair Use Policy to prevent abuse, including:

• Excessive API requests that overload our servers.

• Automated scraping, data extraction, or replication of our AI models.

• Any conduct that disrupts or degrades service for other users.

Users engaging in unfair or excessive use may face account suspension or restricted access.

7. Intellectual Property

All content, including software, algorithms, trademarks, and design elements, are owned by Infernal Labs Pty Ltd and protected by copyright, patent, and intellectual property laws.

You may not copy, distribute, or modify any WinWise content without express written permission.

8. Privacy & Data Protection

8.1 Data Collection

Infernal Labs Pty Ltd collects personal information as outlined in our Privacy Policy, including:

• User account details (name, email, subscription status)

• Usage analytics to improve prediction models

• Device information for security monitoring

8.2 How We Use Your Data

We use your data to:

• Improve and personalise lottery predictions

• Maintain security and prevent unauthorised access

• Comply with Australian regulatory requirements

We do not sell, rent, or share your personal data with third parties for marketing purposes.

9. Security & Account Protection

9.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials. WinWise is not liable for unauthorised access caused by weak passwords or credential sharing.

9.2 Breach Notification

In the event of a security breach affecting user data, we will notify affected users and take remedial actions in accordance with Australian privacy laws.

10. Service Modifications & Termination

10.1 Changes to Service

Infernal Labs Pty Ltd reserves the right to:

• Modify or update features to improve performance

• Discontinue certain services if necessary

• Adjust subscription pricing with reasonable notice to users

10.2 Account Termination

We may suspend or terminate user accounts if:

• Users violate these Terms & Conditions

• Fraudulent or abusive activity is detected

• Service misuse affects system integrity

Users may also request account deletion via our support team.

11. Dispute Resolution & Governing Law

11.1 Governing Law

These Terms are governed by Australian law, specifically the Competition and Consumer Act 2010 (Cth).

11.2 Dispute Resolution

• Users agree to resolve disputes informally by contacting WinWise support.

• If unresolved, disputes may be referred to mediation or arbitration in Australia.
